Welcome to RegenRadar Live NL. These Terms of Use ("Terms") form a legally binding agreement between you ("you" or "User") and Deep Orbit B.V. ("Deep Orbit," "we," "us" or "our") governing your access to and use of the RegenRadar Live NL mobile application on iOS and Android, and any related documentation or services (collectively, the "Service").

By downloading, installing, accessing or using any part of the Service you acknowledge that you have read, understood and agree to be bound by these Terms and by our Privacy Policy (together, the "Agreement"). If you do not accept the Agreement, do not use the Service.

1. Licence Grant

1.1 Subject to your continuous compliance with this Agreement, Deep Orbit grants you a personal, revocable, nonexclusive, nontransferable, nonsublicensable licence to install and run one copy of the RegenRadar Live NL application on your personal device(s) solely for your own lawful, noncommercial purposes.

1.2 Except for this limited licence, no intellectual property rights are transferred to you; all title, ownership and interest in the Service remain with Deep Orbit and its licensors.

2. The Service

RegenRadar Live NL provides live rain radar, shower forecasts and weather information primarily for the Netherlands. Weather data is obtained from third-party providers and may be delayed, incomplete or inaccurate. The Service is for general informational purposes only and is not a substitute for official weather warnings, emergency alerts or professional advice.

4. Connectivity, Location & Devices

Certain features require an active internet connection. You are responsible for obtaining and paying for network access and data charges. Deep Orbit is not liable for reduced functionality caused by connectivity limitations, device incompatibility or outdated operating systems.

If you grant location permission, the app may use your approximate location to show nearby rain radar information. Location is used locally for weather display and is not stored or shared as described in our Privacy Policy. You can change or revoke location permission at any time in your device settings.

5. Third Party Services & Links

The Service may integrate with, or be distributed through, platforms such as the Apple App Store and Google Play, and may rely on third-party weather data providers and technical services (for example Firebase and weather APIs). Deep Orbit does not control and is not responsible for third-party services. Your use of such services is subject to their separate terms and policies.

6. Updates & Changes to the Service

We may (i) push automatic updates, patches or new versions, (ii) add or remove features, and (iii) discontinue the Service or any part thereof. We will endeavour to keep the Service available, but we do not guarantee uninterrupted or error-free operation.

7. Feedback

If you choose to provide feedback or suggestions about the Service, you grant Deep Orbit a perpetual, irrevocable licence to use such feedback without restriction or compensation.

8. Intellectual Property

All trademarks, service marks, logos, copyrights, database rights and other intellectual property rights in the Service are the exclusive property of Deep Orbit or its licensors. Weather maps, radar imagery and forecast data may be subject to the rights of third-party data providers. Nothing in this Agreement grants you any right to use our marks or third-party data outside normal use of the app without prior written consent.

9. Analytics

We use technical analytics and crash-reporting tools (such as Firebase Analytics and Crashlytics) to understand anonymous usage and improve stability. Details are set out in our Privacy Policy.

10. In-App Purchases & Subscriptions

10.1 Certain features may be available via paid subscriptions or in-app purchases. Prices, billing cycle and included features are displayed at checkout.

10.2 Purchases made through the Apple App Store or Google Play are billed by those platforms and can be managed or cancelled in your store account settings.

10.3 Taxes will be added where required by law. Failure to pay fees may result in suspension or loss of paid features.

11. Refunds, Cancellation & Price Changes

11.1 Cooling off: Where required by applicable law (e.g., EU consumer protection rules) you may have a statutory right to withdraw from your purchase within 14 days, subject to the rules of the applicable app store.

11.2 Cancellation: You may cancel a subscription at any time; benefits remain until the end of the current billing period. Payments already made are non-refundable except as required by law or store policy, or as stated in §11.4.

11.3 Price Changes: We may change prices by providing prior notice where required. New prices take effect on your next renewal; you may cancel before they apply.

11.4 Service Discontinuation: If we permanently discontinue a paid feature or subscription tier for which you have prepaid, we will refund any prepaid, unused portion where required by law or store policy.

12. Indemnification

You agree to indemnify and hold harmless Deep Orbit, its directors, employees and affiliates from any claims, damages or expenses arising out of (i) your breach of these Terms, or (ii) your violation of any law or third-party right.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including fitness for a particular purpose, uninterrupted availability, accuracy of weather or radar data, or error-free operation. You remain responsible for decisions you make based on information shown in the app.

14. Limitation of Liability

Except where prohibited by law, Deep Orbit's aggregate liability arising out of or relating to the Service shall not exceed the greater of (a) the total fees you paid to Deep Orbit for the Service in the 12 months preceding the claim or (b) EUR 50. We shall not be liable for indirect, incidental, consequential or punitive damages, including loss arising from reliance on weather or radar information.

15. Force Majeure

Deep Orbit is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including natural disasters, war, terrorism, labour disputes, Internet outages, failures of third-party weather data providers, or governmental restrictions.

16. Governing Law & Jurisdiction

This Agreement is governed by the laws of the Netherlands without regard to conflict of law principles. The courts of Amsterdam shall have exclusive jurisdiction, except where mandatory consumer protection rules provide otherwise.

17. Changes to Terms

We may modify these Terms from time to time. We will post the updated version on this page and, for material changes, provide notice in the app or by other reasonable means where appropriate. Continued use after the effective date constitutes acceptance.

18. Severability & Entire Agreement

If any provision of these Terms is held unenforceable, it will be modified to reflect the parties' intention or severed, and the remaining provisions will remain in full force. These Terms, together with our Privacy Policy and any policies referenced herein, constitute the entire agreement between you and Deep Orbit regarding the Service.
